Duration of Status Final Rule Published

On Friday, July 17, 2026, the U.S. Department of Homeland Security (DHS) published a final rule in the Federal Register that replaces the longstanding “duration of status” or “D/S” policy for international students and scholars and their dependents in F or J visa status with a new policy that sets fixed expiration dates for their authorized stay.

Under this new policy, students and scholars who need additional time to complete their studies or research program will need to file an application with DHS to extend their status.

No immediate action is required by current and incoming students and scholars.  The new policy will not become effective until September 15, 2026.
